The Ministry of Municipalities and Housing announced the approval of rules and procedures governing real estate transactions involving land subject to white land fees, including regulations on cases in which property transfers may be restricted, subject to specific conditions and procedures.
The measures will help regulate real estate transactions, take into account the needs of landowners and developers, and support the continuity of real estate development and investment projects, SPA reported.
The ministry clarified that the cases include the following: Contributing the entire land as an in-kind share in the capital of a real estate investment fund, dividing an estate among heirs, selling the land to a buyer who undertakes to develop or build on it within the additional period granted to the fee payer subject to the specified conditions, subdividing or consolidating fee-subject land among the same owners for development purposes. This is in addition to property transfers based on judicial rulings, transactions carried out under approved off-plan sale and lease projects, and transactions involving the government as a party, or arising from expropriation for public interest and temporary seizure of properties.
The ministry stressed that documenting transactions in these cases requires completing the necessary regulatory procedures, while continuing to comply with the payment of applicable fees in accordance with the specified rules. It noted that these cases do not constitute exemptions from fees, but rather regulatory pathways allowing certain transactions to be documented in accordance with their legal requirements.
It explained that the approval of the rules comes in implementation of Cabinet Decision No. 263, dated 12/3/1448 AH, which stipulates that real estate transactions transferring ownership of land subject to white land fees may not be documented until verification that the applicable fees have been paid.
