The Capital Market Authority (CMA) today, Sept. 30, urged all capital market institutions to ensure compliance with regulatory requirements governing the lending of listed securities, in line with the Capital Market Law and relevant implementing regulations.
The move aims to strengthen practices related to listed securities lending, protect investors’ rights, and support the integrity and fairness of transactions in the capital market.
The CMA said the emphasis on this matter comes as part of its role in regulating the capital market and overseeing the activities and operations of entities under its supervision, as well as its efforts to strengthen compliance with relevant regulatory requirements.
The authority also highlighted its monitoring of capital market institutions’ compliance with securities lending requirements, including suitability requirements when entering into listed securities lending transactions and obtaining the client’s explicit written consent before lending their securities. This comes in accordance with the provisions of the Capital Market Institutions Regulations and the Securities Lending Regulations.
The CMA stressed that it will continue to monitor compliance with the relevant regulatory requirements and take the necessary regulatory measures against practices that fail to comply with such requirements, in order to safeguard investors’ rights and enhance the integrity and fairness of capital market transactions.
