The Ministry of Municipalities and Housing (MOMAH) has offered the proposed amendments to the Implementing Regulations for White Land Fees for public consultation through the Istitlaa platform until Nov. 6, 2026.
The proposed amendments aim to align the implementing regulations with Cabinet Resolution No. 263, dated 12/3/1448 AH, concerning restrictions on transactions involving land subject to white land fees until the outstanding fees have been paid.
The amendments seek to achieve the objectives stipulated in Article 2 of the law, including increasing the supply of developed land to balance supply and demand, expanding the supply of real estate units, protecting fair competition and combating monopolistic practices, and encouraging landowners to develop and build.
The ministry said the amendments also respond to developments in Saudi Arabia’s housing sector and aim to accelerate progress toward these objectives without adversely affecting the real estate market. Accordingly, the ministry, through the White Land Fees Program, has sought to ensure that the regulations meet the intended objectives. The proposed amendment covers Paragraph 5 of Article 13 of the regulations, as detailed below.
Article 13/5 of the White Land Fees Regulations
Before amendment
After amendment
If a fee-paying landowner wishes to sell undeveloped white land before development is completed, the payment period expires, and the owner must pay the fees due on the land before transferring ownership.
The fee-paying landowner must pay the fee when seeking to register a transaction transferring ownership of white land subject to the fee before development or construction is completed. Exemptions from this requirement will be issued following approval by the ministerial committee.
