The rules aim to establish mechanisms for investing in municipal land in exchange for developing it or building housing units for beneficiaries of the Developmental Housing Program or other purposes, in accordance with the regulations governing the disposal of municipal real estate.

Under the draft rules, the ministry may, with the minister’s approval, offer planned land allocated to housing support programs for development and the provision of necessary basic services through an investor selected via public tender.

The ministry will specify in the tender documents how the investor will be compensated for the cost of providing services, through one of the following methods:

– Granting the investor usufruct rights over a percentage of the developed land for a specified period.

– Transferring ownership of a percentage of the developed land to the investor, provided that it does not exceed 20% of the total net land area after development. An exception to this limit may be permitted by agreement between the Minister of Municipalities and Housing and the Minister of Finance.

– Transferring ownership of a percentage of the land to the investor in exchange for developing the site and constructing housing units for Developmental Housing Program beneficiaries, with part of the development plan to be handed over to the ministry for disposal in accordance with applicable regulations.
